Callshake Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Callshake’s website, products, applications, features, software, and related services (collectively, the “Services”).

By creating an account, accessing Callshake, purchasing credit, placing or receiving calls, using a phone number, enabling call recording, or otherwise using the Services, you agree to these Terms, our Acceptable Use Policy, and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services.

Callshake may update these Terms from time to time. When we do, we will update this page. Continued use of the Services after the updated Terms are posted means you accept the updated Terms.


1. Service Description

Callshake provides browser-based Voice over Internet Protocol (VoIP) calling services that allow users to place calls to landline and mobile phone numbers in supported destinations.

Depending on your account, plan, location, number availability, and product configuration, the Services may include outbound calling, inbound calling, phone numbers, caller ID features, call recording, call transcription, voicemail, call forwarding, SMS inbox features, contact management, team features, analytics, and related tools.

The Services rely on your internet connection, browser configuration, device settings, microphone permissions, audio hardware, operating system, and third-party telecommunications infrastructure. Callshake does not guarantee that calls will connect, that audio quality will meet your expectations, or that the Services will be available for every destination, number type, carrier, network, device, browser, or location.


2. Eligibility and Account Responsibility

You must be legally able to enter into a binding agreement to use the Services.

You are responsible for:

  • all activity under your account;
  • keeping your login credentials secure;
  • maintaining accurate account, billing, and contact details;
  • making sure your users, team members, employees, contractors, agents, and representatives comply with these Terms;
  • all calls, recordings, caller ID usage, numbers, messages, contacts, payments, and other activity connected to your account.

You must not create an account using false, misleading, or unauthorized details. You must not create multiple accounts to bypass restrictions, risk controls, payment checks, suspensions, bans, or usage limits.

Callshake may refuse service, suspend access, restrict features, or terminate accounts where we believe account activity is abusive, unlawful, high-risk, fraudulent, harmful, or in breach of these Terms or our Acceptable Use Policy.


3. Business and Team Accounts

If you use the Services on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, “you” includes both you and the entity you represent.

For team accounts, organization owners and admins are responsible for managing members, permissions, numbers, recordings, contacts, billing, and account usage. Callshake is not responsible for internal disputes between team members, admins, employees, contractors, customers, or other parties connected to your organization.


4. Telecom Service Limitations

Callshake is not a replacement for a mobile phone, landline, emergency phone, regulated carrier service, or guaranteed business continuity system.

You understand and agree that:

  • call quality and call completion may vary by destination, carrier, network, route, device, browser, and internet connection;
  • calls may fail, drop, be delayed, have one-way audio, lack ringback tone, connect to voicemail, connect to automated systems, or experience poor audio quality;
  • some destinations, number types, prefixes, carriers, or routes may be blocked, unavailable, degraded, restricted, or charged differently;
  • Callshake may block or restrict calls, numbers, caller IDs, routes, destinations, or accounts for fraud prevention, legal compliance, network protection, carrier restrictions, risk control, or abuse prevention;
  • Callshake may rely on third-party providers to route, connect, process, store, transmit, or support calls and related data.

Callshake does not guarantee uninterrupted service, successful call completion, call quality, caller ID delivery, SMS delivery, voicemail delivery, transcription accuracy, recording availability, number availability, number retention, or compatibility with any specific device, browser, operating system, carrier, network, firewall, VPN, or location.


5. Emergency Services

Callshake does not support emergency calling.

You must not use Callshake to contact emergency services, including 911, 112, 999, 110, or any local equivalent.

You must not rely on Callshake for emergency communication, life-safety communication, medical emergencies, public safety reporting, security alerts, or any situation where failure or delay could lead to injury, death, property damage, or other serious harm.

You are responsible for maintaining separate access to emergency communication services.


6. Billing, Call Charges, and Usage

Callshake may charge for calls, numbers, subscriptions, seats, SMS, recordings, transcriptions, voicemail, forwarding, and other paid features.

By purchasing credit, subscribing, adding a payment method, buying a number, placing calls, receiving calls, enabling paid features, or using paid Services, you authorize Callshake and its payment processors to charge applicable amounts.

Call charges may begin once a call is successfully connected to the destination network, including connections to automated systems, IVRs, voicemail systems, call queues, forwarding systems, or other equipment. A call may be considered connected even if the intended person does not answer or even if you experience local audio, browser, device, or network issues.

Calls may be billed based on connected duration and may be rounded up to the nearest billing increment shown in the product, pricing page, or account interface.

Rates may vary by destination, number type, route, carrier, product, account type, and time. Rates may change at any time unless otherwise required by applicable law.

You are responsible for reviewing rates, charges, subscriptions, usage, and account balance before using paid Services.


7. Credit Purchases, Subscriptions, and Auto Top-Up

Prepaid calling credit is used to pay for eligible usage-based Services. Credit has no cash value, is not a bank deposit, does not earn interest, and is not transferable unless Callshake agrees in writing.

Subscriptions may renew automatically unless cancelled before renewal. You are responsible for cancelling subscriptions you no longer want.

If auto top-up is enabled, you authorize Callshake and its payment processors to charge your payment method when your balance falls below the configured threshold.

Callshake may suspend or restrict Services if your balance is insufficient, your payment fails, your payment method is declined, your subscription is unpaid, your payment appears risky, or your account is under review.


8. Refund Policy

All purchases are final unless otherwise required by applicable law or expressly approved by Callshake in writing.

This includes prepaid calling credit, subscriptions, phone numbers, team seats, usage-based charges, add-ons, upgrades, and paid features such as call recording, transcription, voicemail, forwarding, and SMS.

Prepaid Calling Credit

Prepaid calling credit is non-refundable once purchased unless otherwise required by applicable law.

Calling credit is consumed as eligible usage occurs, including outbound calls, inbound calls, forwarded calls, SMS, voicemail, recordings, transcriptions, number usage, and other usage-based Services where applicable.

Unused calling credit does not have cash value and is not transferable unless Callshake agrees in writing.

Subscriptions and Paid Plans

Subscription fees and plan charges are billed in advance and are non-refundable once the billing period begins, unless otherwise required by applicable law.

Cancelling a subscription stops future renewals. It does not automatically refund the current billing period, partial months, unused time, used features, calls, recordings, transcriptions, phone numbers, team seats, or other Services already made available to you.

Downgrading, disabling a feature, stopping use of the Services, or choosing not to use your account does not entitle you to a refund for the current billing period.

Phone Numbers

Phone number purchases, renewals, subscriptions, setup fees, and related number charges are non-refundable once the number has been provisioned, renewed, assigned, reserved, or made available to your account, unless otherwise required by applicable law.

Callshake does not guarantee that a cancelled, expired, released, suspended, or unpaid phone number can be recovered.

Usage-Based Charges

Usage-based charges are non-refundable once incurred.

This includes charges for calls, inbound calls, forwarded calls, SMS, voicemail, call recording, call transcription, number usage, carrier charges, routing charges, destination-based charges, and other metered Services.

A call may be billable once it connects to the destination network, even if it connects to voicemail, an automated system, IVR, queue, forwarding service, or other answering system.

A call may also be billable even if the intended person does not answer, the call has no ringback tone, you experience audio issues, or you experience local device, browser, network, or internet-related problems.

Technical Issues and User-Side Conditions

Refunds will not be issued for issues caused by or related to:

  • local device or hardware configuration;
  • browser permissions;
  • microphone access;
  • speaker, headset, or audio output selection;
  • operating system settings;
  • internet connectivity;
  • network restrictions;
  • VPNs, proxies, firewalls, corporate networks, or unsupported environments;
  • incorrect numbers entered by the user;
  • calls to unavailable, premium, blocked, restricted, or unsupported destinations;
  • carrier routing issues outside Callshake’s reasonable control;
  • call quality issues outside Callshake’s reasonable control;
  • lack of ringback tone;
  • delay, dropped audio, or one-way audio;
  • user error or misuse;
  • use of the Services in violation of these Terms or our Acceptable Use Policy.

Policy Violations and Restricted Use

Use of the Services in violation of these Terms, our Acceptable Use Policy, applicable law, provider requirements, carrier requirements, payment processor rules, or platform risk controls does not create a right to a refund.

If your account is suspended, restricted, or terminated because of fraud, abuse, unlawful activity, high-risk activity, misuse, or violation of these Terms or our Acceptable Use Policy, Callshake is not required to refund used Services, incurred usage, current billing periods, phone numbers, recordings, transcriptions, or paid features already made available to you, unless otherwise required by applicable law.

Courtesy Refunds

Any refund, credit, or courtesy adjustment issued by Callshake is granted at our sole discretion unless required by applicable law.

A refund, credit, or courtesy adjustment does not mean Callshake admits fault, accepts liability, waives any rights, or agrees to provide future refunds, credits, or adjustments.

Chargebacks and Payment Disputes

If you believe there is a billing issue, please contact Callshake first so we can review the matter.

Abuse of refund requests, chargebacks, payment disputes, payment reversals, unauthorized payment claims, or payment systems may result in account suspension, account termination, feature restriction, cancellation of numbers, recovery of costs, denial of future service, or other enforcement action.

Callshake may submit account records, usage logs, call logs, transaction records, subscription records, cancellation records, communications, IP addresses, device data, acceptance records, and other relevant evidence to payment processors, card networks, banks, or authorities in response to chargebacks, disputes, fraud claims, or payment investigations.


9. Phone Numbers and Caller ID

Callshake may allow you to purchase, verify, assign, use, display, or manage phone numbers and caller IDs.

You understand and agree that:

  • purchasing or using a number through Callshake does not give you permanent ownership of that number;
  • number availability is not guaranteed;
  • numbers may be reclaimed, released, suspended, restricted, removed, or unavailable due to non-payment, cancellation, carrier requirements, regulatory requirements, misuse, account termination, or reasons outside Callshake’s control;
  • Callshake does not guarantee that a cancelled, released, or expired number can be recovered;
  • caller ID display is not guaranteed and may be modified, blocked, labeled, filtered, or unavailable depending on downstream carriers, recipient devices, analytics systems, spam labeling systems, or local regulations.

You may only use caller IDs that you own, control, or are authorized to use. You must not spoof, falsify, misrepresent, or misuse caller ID information.

Callshake may require proof of ownership, authorization, business identity, address, registration details, or other documentation before allowing or continuing number or caller ID use.

Shared Public Caller ID Fair Use

Callshake may make certain shared public caller IDs available for limited outbound use.

Shared public caller IDs are a pooled resource intended for light, occasional usage only. They are not guaranteed, may be rate-limited, and may be restricted, suspended, rotated, or withdrawn at any time in order to protect call trust, answer rates, number reputation, telecom compliance, carrier relationships, network integrity, abuse prevention, or service quality.

Callshake may apply fair use limits based on factors such as call volume, repeated call attempts, destination patterns, account history, risk signals, or other operational considerations. These limits may change at any time without prior notice.

If a shared public caller ID limit is reached, Callshake may require you to verify a phone number you own for caller ID use or purchase a dedicated Callshake number before further outbound calling through shared caller ID is allowed.

Reaching a shared public caller ID fair use limit does not by itself entitle you to a refund of prepaid credit, subscriptions, or other amounts paid, unless otherwise required by applicable law.


10. Call Recording

Callshake may offer call recording features as part of the Services.

If you enable or use call recording, you are solely responsible for determining whether recording is lawful for each call.

You are responsible for complying with all call recording, consent, privacy, data protection, telemarketing, employment, consumer protection, retention, disclosure, and industry-specific laws that apply to your calls. Legal requirements may depend on the locations of you, the people you call, other call participants, and your business operations.

You are responsible for providing any required notice and obtaining any required consent before recording a call. You must not record a call unless you have confirmed that your use of call recording is lawful.

Callshake does not provide legal advice, does not determine whether any call may be lawfully recorded, and does not guarantee that your use of call recording complies with applicable law.

You agree that Callshake is not responsible or liable for your use or misuse of call recording, including any failure to provide required notice, obtain required consent, comply with applicable law, delete recordings, restrict access to recordings, handle recordings properly, or respond to participant requests.

Callshake may disable call recording, restrict access to recordings, delete recordings, suspend your account, or terminate your access to the Services if we believe your use of call recording may violate these Terms, our Acceptable Use Policy, applicable law, or the rights of others.


11. Recordings, Transcriptions, Voicemail, and Stored Content

The Services may allow you to create, receive, store, access, play back, delete, download, or process call recordings, transcriptions, voicemail recordings, messages, contacts, notes, and related data.

You are responsible for your content and for all legal obligations related to that content, including notice, consent, access rights, retention, deletion, confidentiality, security, disclosure, and lawful use.

Callshake does not guarantee that recordings, transcriptions, voicemail, messages, contacts, notes, or other stored content will always be available, accurate, complete, recoverable, or retained for any specific period.

Transcriptions may be inaccurate, incomplete, delayed, or unavailable. You must not rely on transcriptions as official, legal, medical, financial, regulatory, or safety records.

Callshake may remove, restrict, delete, preserve, disclose, or disable access to content where required by law, legal process, risk controls, provider requirements, these Terms, our Acceptable Use Policy, or to protect Callshake, users, third parties, or the public.


12. Acceptable Use

You must comply with our Acceptable Use Policy at all times.

You must not use the Services for unlawful, abusive, fraudulent, deceptive, harmful, high-risk, or unauthorized purposes, including:

  • harassment, stalking, threats, intimidation, or unwanted contact;
  • scams, phishing, social engineering, identity theft, or financial fraud;
  • unlawful caller ID spoofing or impersonation;
  • unauthorized telemarketing, robocalling, spam, or automated calling;
  • violation of Do Not Call rules, consent requirements, consumer protection laws, or telecom rules;
  • recording calls without required notice or consent;
  • use of synthetic voices, voice cloning, or deepfake audio for deception or fraud;
  • traffic pumping, artificial traffic generation, abnormal calling patterns, or telecom abuse;
  • attempts to bypass risk controls, verification, usage limits, bans, payment checks, or enforcement actions;
  • use that violates sanctions, export controls, embargoes, or restricted-party rules;
  • use that infringes privacy, intellectual property, publicity, contractual, or other rights of others.

Callshake may investigate suspected violations and may suspend, restrict, terminate, or report accounts or activity where appropriate.


13. Compliance With Laws

You are solely responsible for using the Services in compliance with all laws, rules, and regulations that apply to you, your business, your users, your calls, your contacts, your recordings, your messages, your payments, and your destinations.

This may include telecom laws, consumer protection laws, call recording laws, privacy and data protection laws, telemarketing laws, Do Not Call rules, employment laws, financial services rules, healthcare rules, sanctions, export controls, tax rules, and industry-specific requirements.

Callshake does not provide legal, tax, telecom compliance, privacy, regulatory, or business advice. You are responsible for getting advice from qualified professionals before using the Services in regulated or high-risk contexts.


14. Monitoring, Abuse Prevention, and Security

To protect the Services, users, third parties, providers, payment systems, telecom networks, and the public, Callshake may monitor account activity, payment activity, usage patterns, traffic metadata, call volumes, destinations, caller ID usage, risk signals, device data, IP addresses, and related information.

Callshake does not routinely monitor call content, but may access, preserve, review, disclose, restrict, or remove content where required by law, legal process, provider requirements, risk review, abuse investigation, security review, user support, or to protect Callshake, users, third parties, telecom networks, payment systems, or the public.

You must not attempt to interfere with, bypass, overload, scan, attack, reverse engineer, scrape, disrupt, or gain unauthorized access to the Services or related systems.


15. Third-Party Services and Providers

The Services may depend on third-party providers, including telecommunications carriers, routing providers, cloud infrastructure providers, payment processors, analytics providers, communication providers, and other vendors.

Callshake is not responsible for failures, outages, delays, errors, restrictions, pricing changes, routing changes, number availability issues, blocked calls, spam labels, payment declines, or other acts or omissions of third-party providers.

Use of certain third-party features may be subject to additional terms, policies, rules, or restrictions.


16. Privacy

Your use of the Services is subject to our Privacy Policy.

You are responsible for providing any required privacy notices and obtaining any required consents from your contacts, call participants, team members, employees, contractors, customers, leads, and other individuals whose personal information you submit to or process through the Services.

You must not upload, import, store, record, process, or use personal information through the Services unless you have the legal right to do so.


17. Intellectual Property

The Services, website, software, design, branding, logos, content, documentation, and other materials provided by Callshake are owned by or licensed to Callshake and are protected by copyright, trademark, and other laws.

Subject to these Terms, Callshake grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for lawful purposes.

You must not:

  • copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services;
  • reverse engineer, decompile, disassemble, or attempt to extract source code from the Services;
  • remove copyright, trademark, or proprietary notices;
  • use Callshake’s name, branding, or marks without written permission;
  • use the Services to build, train, benchmark, or support a competing product without written permission.

This license ends when your account is terminated or when you stop being authorized to use the Services.


18. Feedback

If you send Callshake ideas, feedback, suggestions, bug reports, feature requests, or other comments, you grant Callshake a perpetual, worldwide, royalty-free, irrevocable right to use them without restriction or compensation.


19. Accuracy of Materials

Information on the Callshake website, help pages, pricing pages, product pages, directory pages, rate pages, and related materials may be general, incomplete, outdated, or subject to change.

Callshake does not warrant that website materials, product descriptions, rates, availability, documentation, or linked resources are accurate, complete, current, or suitable for your intended use.

You are responsible for verifying information before relying on it.


20. Links

The Services may contain links to third-party websites, resources, products, or services.

Callshake is not responsible for third-party content, websites, policies, products, services, or practices. The inclusion of a link does not imply endorsement, approval, control, or responsibility.

You use third-party links and resources at your own risk.


21. Suspension and Termination

Callshake may suspend, restrict, or terminate your account, access to the Services, phone numbers, caller IDs, routes, destinations, recordings, messages, contacts, subscriptions, credits, or features at any time if we believe:

  • you violated these Terms or the Acceptable Use Policy;
  • your activity is unlawful, abusive, fraudulent, deceptive, harmful, high-risk, or unauthorized;
  • your payment method is invalid, unauthorized, declined, disputed, reversed, or associated with fraud;
  • your usage creates risk for Callshake, users, third parties, providers, carriers, payment processors, networks, or the public;
  • we are required to do so by law, legal process, provider requirement, carrier requirement, regulator request, or risk control;
  • continuing to provide the Services may expose Callshake to liability, abuse, operational risk, security risk, payment risk, telecom risk, or regulatory risk.

Callshake may terminate these Terms immediately upon notice to you if you breach them.

Upon suspension or termination, you may lose access to your account, numbers, recordings, messages, contacts, credit, subscriptions, and other data. Callshake is not responsible for losses caused by suspension, restriction, or termination made under these Terms.

Unused credit may be forfeited where your account is suspended or terminated for fraud, abuse, payment disputes, chargeback abuse, unlawful activity, or violation of these Terms or the Acceptable Use Policy, unless otherwise required by applicable law.


22. Discontinuation and Changes to the Services

Callshake may modify, limit, suspend, discontinue, remove, replace, rename, reprice, or change any part of the Services at any time.

This includes features, plans, rates, destinations, routes, phone number availability, billing increments, recording features, transcription features, storage features, team features, support channels, and account limits.

Callshake is not liable for any loss or damage arising from changes to or discontinuation of the Services.


23. Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, Callshake disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, accuracy, security, and uninterrupted operation.

Callshake does not warrant that:

  • the Services will be uninterrupted, secure, error-free, or available at all times;
  • calls will connect or meet any quality standard;
  • caller ID will display correctly;
  • recordings, voicemail, messages, or transcriptions will be accurate, available, complete, or retained;
  • rates, routes, destinations, numbers, or features will remain available;
  • defects or errors will be corrected;
  • the Services will meet your business, legal, regulatory, operational, or technical requirements.

You use the Services at your own risk.


24. Limitation of Liability

To the maximum extent permitted by law, Callshake and its owners, officers, employees, contractors, service providers, suppliers, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including loss of profit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use, loss or corruption of data, service interruption, telecom failure, failed calls, blocked calls, poor call quality, payment issues, regulatory consequences, or damages arising from your use or inability to use the Services.

To the maximum extent permitted by law, Callshake’s total liability for any claim arising out of or related to the Services will not exceed the greater of:

  • the amount you paid to Callshake for the Services giving rise to the claim during the three months before the claim arose; or
  • USD $100.

These limitations apply whether the claim is based on contract, tort, negligence, strict liability, statute, indemnity, or any other legal theory, even if Callshake has been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability. In those cases, the limitations apply to the maximum extent permitted by applicable law.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.


25. Indemnification

You agree to defend, indemnify, and hold harmless Callshake, its owners, officers, employees, contractors, service providers, suppliers, and affiliates from and against any claims, disputes, demands, proceedings, damages, losses, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

  • your use or misuse of the Services;
  • your violation of these Terms or the Acceptable Use Policy;
  • your violation of applicable law;
  • your calls, caller ID usage, recordings, messages, contacts, content, payments, or account activity;
  • your failure to provide required notice or obtain required consent for call recording;
  • your fraud, abuse, chargebacks, payment disputes, or unauthorized payment activity;
  • your infringement or violation of any rights of another person or entity;
  • activity by your users, team members, employees, contractors, agents, representatives, or anyone using your account.

This obligation survives termination of your account and your use of the Services.


26. Notices

Callshake may send notices to you by email, account notification, website notice, or other reasonable means.

You are responsible for keeping your account email address current. Notices sent to your account email are deemed received when sent.

27. Assignment

You may not assign or transfer these Terms or your account without Callshake’s prior written consent.

Callshake may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, restructuring, sale of assets, change of control, or by operation of law.


28. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be severed or limited to the minimum extent necessary, and the rest of the Terms will remain in effect.


29. No Waiver

Callshake’s failure to enforce any part of these Terms does not waive our right to enforce that or any other part later.


30. Entire Agreement

These Terms, together with the Acceptable Use Policy, Privacy Policy, and any product-specific terms, billing terms, or plan terms presented to you, make up the entire agreement between you and Callshake regarding the Services.


31. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to conflict of law rules.

You irrevocably submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising out of or related to these Terms or the Services.
